Legal Question in Credit and Debt Law in Florida

Loan Default

I am wondering how to proceed to collect upon a debt that is owed me by an individual. I have a signed loan document that outlines payment terms and have served the 30 pay notice but the debtor has completely ignored me. What steps do I need to take to collect my money? The principle amount owed is $28K.

Re: Loan Default

You would need to file a lawsuit based upon a default in the terms of the note. You may first want to deterine if the person is collectable or not. Feel free to call or e-mail me if you wish to have some assistance with this matter.

Re: Loan Default

You need to file a breach of contract lawsuit in circuit civil court.

It's enough money, though, that you ought to consider using a lawyer. Circuit civil isn't the "people's court." Circuit civil has complex rules and procedures where, unlike in small claims court, the judges can be unforgiving for those who make mistakes.
