Legal Question in Credit and Debt Law in Florida

I loaned some friends 25,000.00 to buy a home back in 2003 but they could not get it at that time for some reason. I called them and in New York and asked what the proplem was and they said that the person they hired to draw up there plans didn't finsh them. I called them again and they said that they just had a baby and there wss some problem with her, Then I deplyed to the middle east with the military, apone my returne back home they have moved again this they left no address just found a PO Bpx tryed to send a card but it was returned. I looks like they just bought a home. I tryed to call them but they will not return my calls. Do I have the right to sue.

Lee, you may have a real problem here. You do not mention what state the loan was made in nor if it was in writting. All states have a certain period of time in which to sue someone. In Florida, it is 4 years if not a written contract and 5 years if a written contract. If they made any payments at all, it may extent the time period in which to file suit. See an attorney in your area immediately and bring all information and paper work.

It may be too late to sue them because of the time limit to file a case in court. However, if you were deployed out of the country for a period of time, the time limit to file a case may have been "stayed," which would give you extra time. Still, depending on the dates when you made the loan, whether there was a written loan agreement or not, where everyone was living when the loan was made, and other factors, it may be too late. Yes. You can sue them -- but hurry. You may not have much time. It depends on when ythey were supposed to pay you back. See a lawyer right away.
