loaning a friend money

I loaned a friend money and got them to sign a piece of paper saying how much I loaned them and the date I made the loan. Now this person will not return my calls and will not pay me back. My question is can I take them to small claims court or can I sue to get the money owed back. I have the canceled check that I wrote them (with loan wrote on the check) I have several emails where this person was pleading to borrow money to pay hospital bills. In the emails they said the would sign what ever to get the money from me and would pay it back..... Is there any way I can get my money back ????

there may be some issues regarding the time period in which your friend was suppose to pay you back, but that should not bar your ability to file in small claims court

By going to small claoms court, you are suing. Go for it.
