Legal Question in Credit and Debt Law in Florida
I've had major problems with an air conditioning company who installed all new duct work only to find out that wasn't the cause of the problem. They also promised me a new "better" programmable thermostat to replace the one I just purchased. The one I installed was programmable, the one they replaced it with was not programmable. They said the contract just stated a digital thermostat, and did not specify it would be programmable. I refused to pay until they installed the programmable thermostat their technician promised. They have sent me notice to put a lien on my house over this and I have to go to mediation before trial. Do I have to pay mediation costs? Would I have to pay for their lawyer if we go through mediation? I think this is crazy to go through all these legal costs over a thermostat, but what they did was flat out lie and I don't want to give in and pay when I know I'm right. What chance do I have if it's just my word; against their tech? There were many other problems with the job that I won't get into, but the company has a D- rating with the BBB and several other complaints I've found on the internet.

The mediation cost is usually divided bertween the two parties. However, if they are suing you, they will pay unless you lose the case in which case you will pay all fees. I suggest you get your ducks in a row.
