Legal Question in Credit and Debt Law in Florida

Mandatory Arbitration

My wife has a credit card debt from before we were married. She just got served with a notice of mandatory arbitration. The account has been assigned several times by the original creditor and she has been unable to get any breakdown of the debt or copies of contracts that she signed that agreed to the arbitration. They just have a figure they say she owes and do nothing to support that figure. Is there a way to fight mandatory arbitration ?

Re: Mandatory Arbitration

This is a complex area of the law. It is important for you to understand that if you do not proceed to demand proof of the payments in the "arbitration court" you may waive all your rights. I would ask for proof that you agreed to mandatory arbitration.
