Missed Deposition with special circumstances

I missed a court order deposition from a credit card company because an incorrect contract was faxed to me. I refused to sign the contract and sent a letter of explanation asking for a corrected contract. I never received a contract. I am now being threatened to get legal counsel because they are filing for ''the missed depositon''. What is the next step that they can take? What should I do?

Agree to a new date and show up. Or, retain counsel to review what has happened. It seems that a judgment has been entered against you.
