Legal Question in Credit and Debt Law in Florida
monetary lawsuit
Rewards Networks loans money to restaurants/nightclubs all over the country. Rewards based in Chicago and their contracts say the have jurisdiction in other states. The contract for the repayment of money was signed by the Pres. of corp. and my husband who for 3 months was secretary in name only (so he could sign checks for deliveries etc.). After 3 months he resigned and took his name off the corporation, he did not like practices people involved in the business. At the time of the signing the President and ''another person involved'' told my husband that he would not be financially responsible for anything. He signed the contract being solely and dually responsible. The President of the now defunct corporation is a lawyer and has many more lawsuits and much more money than we do but since my husband signed the paper (legally binding but morally wrong)and he is the only one Rewards Network can find he is being held responsible. The question is if i sell my house to just me - can Rewards lawyers still put a lien on the house even tho the sale is after the fact??

You should really post this question for an Illinois attorney to respond to. In Florida, the person signing a corporate check would NOT be liable for the debt of the corporation. Investigate the legality of the judgment before you worry about whether it is a valid lien on your house. You may have to hire an attorney in Chicago to defend in improper lawsuit against your husband.
