open accounts vs written contracts

Is a credit card account an 'open account' or a 'written account/contract'?

User signed an application, but did not sign the ''User Agreement''. Use of the card was the indication that the user agreed to and accepted the ' User Agreement' The User Agreement sited the State of Delaware as the jurisdiction State, suit was brought in the State of Florida where user presently lives.

Where in the Florida Statutes is this subject defined and governed.

Is there or where can I find any case law which may clearify this issue?
