Legal Question in Credit and Debt Law in Florida

Outstanding Account

I purchased a bedroom suite from Rhodes Furniture several years ago. Rhodes as since filed for Chapter 11. I have a debt managment program that includes my Rhodes account. I have not recieved a statement of any kind from Rhodes in over a year and Room To Go took over Rhodes but said that they don't deal with past Rhodes customers. I'm wondering what they're obligations are in informing me about my account and what my obligations are.

Re: Outstanding Account

You should immediately look up the bankruptcy case and if it isn't too late, file a claim. Also look for the Plan which will spell out your rights. Unfortunately, it may be too late to try to oppose the plan.

If you do not agree, then stop right here, and do not read any further.

I presume that you have received the furniture and are in the process of paying for it. The Rhodes account is probably owned by another company and not actually Rhodes. You need to check your last statement and see who that company is. If you fail to take care of this obligation in bankruptcy, it will remain after the bankruptcy and you will owe the full amount plus your delinquency will remain for a longer period. This will not do you any good. Take care of this now.
