Legal Question in Credit and Debt Law in Florida
I owe money on a credit card and missed a payment in Sep. 2010. They closed the account which took away my online access. They called at the end of Oct. and I asked if I could make a payment over the phone for free and they said yes. A few days later I attempted to use my ATM card and it said my account was overdrawn. The credit card company had taken out the authorized payment 5 times which zeroed my bank account and caused my account to be assessed an NSF fee. I called the card company and they said to fax them documents showing the fee and they would credit the fee plus the extra payments. After 3 days, this was still not done and I was told the employee at the card company failed to submit the request. The next day, they took out another payment and my account was charged another NSF fee. Eventually they credited back the extra payments and one of the NSF fees. I received a letter from the card company saying they would not pay the other. I told them until this is done I will not make another payment. As a result, the late fees and interest keep piling up. What are my rights?
