If Im trying to pay my credit card debts, can they still request a judgment?

After fighting to keep out of bankruptcy I have recently gotten my finances back to were I am paying my old credit card debts. However one of the Credit card companys refuse to accept any repayment proposal without filing for a summary judgment first. Can they do this even though I am sending them what the credit counceling agency had determined is the maximum I can afford, or for that matter if I am making what would have been a normal payment prior to my financial problems?

What is best for your financial planning can be determined after a consultation with counsel. In your current condition, the creditor is not required to accept a lesser amount or payments. Accordingly, the answer to your question is yes.
