I was phoned today by a man, Jim Cane, who said he was an attorney with Henry and Puller and Associates and that I am being prosecuted and sued for an unpaid online payday loan in the state of Florida (which I live). He said an ACH transaction is like writing a check and is fraud. He told me that since I work for the public schools system I would loose my job and be prosecuted to the fullest extent, even arrested. I belive the loan amount originally was fo $500. I was told that no criminal action could take place for defaulting on a loan, from another website. He told me that I had 'til 12:00 today to pay at least $500 of $745 or that it was being ran through. I took a payday loan out with the co. he mentioed in march and have yet to repay. I have fallen on hard times with intent to repay, just cant now. What should I prepare for and is any of his threats true?

Sounds like he's violated your rights under the Fair Debt Collection Practices Act. It also sounds like he's told you a lot of lies. You probably do owe the money, but you can't be prosecuted for defaulting on a payday loan. You may want to speak with a lawyer who handles Fair Debt Collection Practices Act cases.
