Paying a debt that is not yours
My mom is a senior citizen on social security. While under emotional distress due to death in the family, someone she trusted used a credit card under my mom's name and ran it up to the limit. My mom was unaware of this card and never saw a statement. She was summoned two years ago, where I responded to the summons, advising she did not have a credit card and was victim of identity theft. The judge instructed the collection agency to ask for statements and prove they belong to mom, but to have all communications thru me due my mom's health condition. They were also suppose to correct the mailing address as it had been incorrect on all documents. The statements have been sent to my mom directly, with the address still incorrect, and my mom wants to just tell the company that she will pay $100 a month as after evaluating the statements, she now knows who used the card. She does not want this case to go any further. I am ticked off as the agency did not send the docs to my attention, based on the POA I have, as everytime my mom gets these communications it affects her health even more. How can I resolve this?

Without having control of your Mom, who owns the card, there is little one can do. Certainly, she is not responsible for credit card theft if the proper actions have been done.
