Legal Question in Credit and Debt Law in Florida

I have been paying $100 a month on a $600 debt for a credit card. This was agreed upon verbally and not in writing. I missed my last payment due to the holidays and they left me a voicemail saying that if I don't call them and make a payment then they will null and void the agreement including all the payments I have already made ($400). I called them and said I can pay the $100 this Thursday and I apologize for being a week late. They said they need $210 by Dec 31st and they will settle the account. I don't have 210 but I can pay 100 on Thursday. Can they really void the monies I've paid already? Or have they broken the law? Also they have called me at least 10 times in the last 2 business days (not counting the weekend). Is that harassment? I live in Florida and the debt was made here

First, they cannot void your payments. They will have to file a lawsuit to collect $200. It will cost them more to file than what is owed. They will not file. They are just trying to play hard ball and scare you into paying off the bill.

Why are they asking for $210 if you only owe $200? Adding penalties may be a violation of law. Certainly calling you as many as 10 times in one day is a violation of law. Use this to your advantage. Tell them you are going to get a lawyer because they violated the law. Get them to agree to a total settlement of $100 more to resolve the matter. Get it in writing.

Good luck. See www.ConsumerLawyerHelp.com for more help.
