payment plans

we gave a guy $1435.34 for carpet, he never gave us the carpet. if we accept a payment plan and he sends only one payment and no others would we be able to take him to court? Or would we be unable to?

yes, you could still sue. I suggest you get the payment plan and admission of the debt in writing.
