Legal Question in Credit and Debt Law in Florida

Payroll check

I received a call today from a collection agency stating a ''payroll'' check from one of my past employers bounced 2 years ago, the actual amount was 689.34, i was unaware this check bounced and now there stating i owe 17oo.00 for the fees also, they advised they were issuing a felony warrant out for me, yet, i was never aware that the employers check was never cleared. Is this my fault ? And what type of defenses do i have?

Re: Payroll check

The action by the collection agency is a violation of the FDCPA. You may have civil liability, but unless you knew or should have known the check would bounce there should be no criminal liability.

Re: Payroll check

Unless you knew there were insufficient funds I do not see any criminal responsiblity.
