Legal Question in Credit and Debt Law in Florida

pending law suit

i was perusing my county public records when i discovered that LVNL Funding had a pending lawsuit against me from mMarch,2008. I happen to know the statute of limitations has run out (though i believe they illegally reaged the debt). Should i contact the court or LVNL with some sort of letter letting them know i know my rights? Have never been served in person or by postman. Also what does dismissed before hearing mean? many thanks.

Re: pending law suit

If you have not been served, it means that you do not have to answer the complaint. Dismissed before a hearing means probably that LVNL dismissed the claim. However, I would visit or call the clerk's office to see it that is correct. It is impossible to tell without seeing in file.

I would not recommend you contacting anyone at this time. Let the statute run or continue to run. If you contact them, it may end up with them serving you.

Statute of limitations depends on what contract says, and whether it is signed contract or not.
