Legal Question in Credit and Debt Law in Florida

A pre-paid credit card company has been taking out payments on a card i never activated and i called several months back and spoke with someone and assumed it was taken care of. i work on the road so i havent paid attention to my acct. I looked over my acct during the holidays to discover they are still taking $24.95 a month and have been since the card was sent. I spoke with a lady at the company and she acknowledged that the card had not even been activated and then transferred me to a supervisor who said it would take 60 days to investigate??? Is this legal? What can I do?

If they do not correct it and continue to bill you, they may be in violation of the Federal Fair Credit Billing Act and Florida's Deceptive and Unfair Trade Practices Act. Usually a letter addressed to the credit card company with a cc: to the Florida Attorney General and Department of Consumer Affairs and Agriculture does the trick.
