Legal Question in Credit and Debt Law in Florida
Problem getting bank to delete false info
About 6 years ago my checkbooks, drivers license and other items were stolen from me. I notified the bank and they had me fill out some forms and they said they would take care of everything. After a few years they report me to equifax for a debt. I disputed the debt. They claime it was mine. I sent them 3 certified letters asking for verification of the debt. No rseponse. Today I went to the bank in person. The branch manager informed me that, they did not need to verify the debt. All they needed to do was say it is mine. I told her that I wanted copies of checks with my signature or something that validate the debt as mine. She replied ''we don't have that. We may be able to research further, we will charge you for the research''.
Due to their refusal to move this, I was unable to close home mortgage this week and it looks like I won't be closing next week either.
I amm looking for an attorney that can handle this.

The attorney handling your closing should be able to take care of this. This may require some legal action against the bank if they will not accept your sworn affidavit. Goodluck.

Any releif you are entitled to will be found in the provisions of the Fair Creditt Reporting Act and to a much lesser extent, int he Fair Debt Collection Practices Act. Have your atty, the one you employed to to your closing, review the appropriate provisions and then act to protect your interests.
