Legal Question in Credit and Debt Law in Florida

I purchased some carpet padding in 2003 I paid for it. 1 year later I was severd with a summons saying I did not pay. they hired an Attorney and sued me. So I had to pay again. Today I found the check that I paid them $ 2,826.00 Do I have any recourse

There are a few things you can do, but the time between events may have barred you form doing anything. Obvioulsy, this is an in-equitalble situation. You can approach the company and see if it will makes things right. You can apply to the court to set the judgment aside and request reimbusement and possibly other damages. There is not harm in trying eve n if the time has barred you from it ( I am not sure, since I am at home and have not had a chance to look at the rules). Lastly, you to sue the campany for violation of Florida's Fair Debt Practices Act. You will need someone who does this kind of law. I do, but I only handle cases in south Florida. I believe you are barred at this time of proceeding. However as Mr. Marino states, it does not hurt to try.
