Legal Question in Credit and Debt Law in Florida

Purchasing Property can a Creditor put a lien against it

I am single and head of household in FL. I have a few small judgements against me. I am going to purchase some property with my boyfriend and its owner financed. My boyfriend also owns a business and has 2 judgements against him. Can a creditor put a lien against the property? If so, will filing BKC wipe the judgements out? It will be our homestead in about 1 yr. Thanks for any help.

If there are perfected judgments, then if you purchase the real estate, the judgment liens will attach. If you were to finance the purchase the lender would insist on payment of the antecedent liens. However, if you file for bkc protection you can avoid the effect of the liens and the underlying judgments. I suggest that if you are in my area you call for an appointment in order that we can fully discuss your situation.
