Legal Question in Credit and Debt Law in Florida

quashing wage garnishment

I have received a plaintiffs motion for continuing writ of garnishment against salary or wages after judgement. An exemption form was included. 1) do i need an attorney to file for exemption? 2) since I currently have a federal tax lien on my home, does this qualify as an exemption? My children are both past the age of 18 however both still reside in my home. This action stems from voluntary repossession of a 2nd business vehicle I could no longer afford after selling my business.

You should immediately consult with a competent creditors' rights lawyer to determine firstly if you even qualify for an exemption. Further a review of your overall financial status may be in order.

You do not need an attorney but is recommended. Also, the Federal tax lien and children over 18 are not exemption. Call an attorney to work on solving problem.
