Legal Question in Credit and Debt Law in Florida
I received a summons from Citibank for a credit card debt. I do not dispute the debt, but I am on Social Security Disability and a Disability pension from Florida Retirement System. I was told that my disability cannot be garnished, and that because Florida is a Homestead state, they cannot apply a lien on my home. Should I answer the summons?

Yes. You should always answer a summons. Otherwise they will obtain a default by judgment and yes they can add that to your home. Homestead just means they can not take your home but they can apply a lien to it.

You should dispute the bill because they are almost always wrong and see a consumer lawyer. See www.ConsumerLawyerHelp.com for garnishment and for a NACA lawyer in your area.
