Legal Question in Credit and Debt Law in Florida

I recently gave notice to an individual, who lives out of state, notice that I was putting my modular home back on the market due to his failure to pay me. There is no property involved. The balance due me is $61,000. If I hire an attorney, what is the procedure regarding filing for default for balance due? I'd like to put this house back on the market as it is in Marathon Fl. and in a favorable mobile home park. Thank you, Janis

An attorney needs to review the agreement between you and the purchaser to determine if there is a breach of agreement. If the buyer is in default and or breach, then you need to file suit against the buyer. You may need to serve the complaint on the buyer. Court costs are about $400 to $500, and attorneys' fees would be in addition to this.
