Legal Question in Credit and Debt Law in Florida

I am getting re-married to a New York resident, though I am a Florida resident. I am currently in forclosure mediation for my home in Florida. I will not be moving to NY until this situation is finalized, but I would like to know if that liability will transfer to my new husband when all is final. The house is in my name only. I will probably need to file bankruptcy after foreclosure as my loan is far more than the value of my home, and the shortfall will be more than I could ever repay. Will my new husband's credit be affected?

Should not affect new husband, as long as he does not sign anything making him liable for you debts. Want to know the law? Sign up for our free newsletter on varies areas of the law by sending an email to [email protected] and requesting the newsletter, or go to www.ConsumerLawyerHelp.com

You should consult with a Florida attorney on this matter. If your husband to be has comingled any funds with you, he might be. If all is separate and nothing will be comingled, then perhaps not.
