Possible Repo

In August 2001, I refinanced my 2001 Ford Ranger through my credit union. In October I unexpectedly relocated to another state and became unemployed. Through savings and other means I continued payments for the vechile until January 2002. At that time all sources of income ran out.

I'm now employed and able to very quickly (in 6 weeks) catch up all back payments.

I've already made one double payment, which was not applied to the loan. Also the account has been frozen. When I called the credit union today about the payment not being applied to the loan, they said a repo order had already been placed and it didn't matter if I caught up the payments or not. Do I have any recourse?

You should immediately retain competent counsel to protect your interests. Do not leave the vehicle in a vulnerable position. You can file for bankruptcy protection. That would stay all action by the creditor. Although bkc has many repercussions, the cost would be less than that of not getting the vehicle returned.
