Legal Question in Credit and Debt Law in Florida

The repo man just showed up at my front door and demanded my wife to tell him where my vehicle was. She refused and was told he would be back shortly with the police and that she and or I would go to jail if she refused to tell him where my vehicle was located. Is this legal?

No, and It may be a violation of the FL debt collection statute. A debt collector may not threaten arrest when collecting on a debt.

His conduct was absolutely illegal. The Sheriff's office will not get involved in a civil matter like this unless there is a writ directing him to seize property.

I would make notes of the conversation, contact the lender to let them know what happened (in a non-confrontational way) and then conatct the Florida Attorney General and file a complaint.
