Legal Question in Credit and Debt Law in Florida

Who's responsible?

My father recently passed away leaving my mother woth approximatly 35,000.00 in credit card debit. All of the credit cards were in my fathers name although my mother was an authorized user on several of them.

My mother is now a 71 year old widow living on 800.00 a month social security as her only income. My father had no will or estate to speak of. Who is now responsible for this debit? Can we file bankruptcy on my deceased father?

Thank you

Re: Who's responsible?

Your father's estae is liable. However, to the extent of your mother's actual use she may have liability. See previous reply.

Re: Who's responsible?

Although your fathers' estate, if any, is liable, by actually using the card, your mother may also be responsible to that extent. Read the credit card agreement.
