Legal Question in Credit and Debt Law in Florida

secondary card holders

my question is about the following: I filed bankruptcy about 6 yrs ago. My husband is currently filing bankruptcy.

A few yrs back he received a preapproved credit card app. He called them listed me as a seconday card holder no papers were ever signed. There telling me that my name was placed on this account leaving me fully responsible for this debt. I would like to know if this is possible with out a signature from me. I called requesting a copy of the original application that would show my signature but since it was preapproved there isn't one. They have also listed this debt on my credit report.

Re: secondary card holders

Based upon your statement, it appears you have no liability. If the demands persist you may have a claim for violation of the Fair Debt Collection Practices Act.
