Legal Question in Credit and Debt Law in Florida

Just got served. Old CC

In the documents they have a pre trial date established. Should I respond in writing to the court as well as the attorney or just show up on my pre trial date? If responding in writing what response should I use?

You should answer or move to dismiss and appear at the hearing. What form the answer or motion takes depends on the circumstances. Too many different circumstances to list, but best are to dismiss: 1. failed to attach all the necessary documents and 2 statute of limitations ran.

In small claims court, you're allowed to just show up at the hearing, though it's always best to respond in writing as well.

In all other kinds of court, you have to file some sort of response in writing with the clerk, copied to the attorney, usually within twenty days.
