Legal Question in Credit and Debt Law in Florida

Services rendered price in dispute

Recently a company was called for a price on a survey. A price was quoted for a survey service and a go ahead for the survey was given. A short time later, after the survey, a bill was submitted to the person who authorized the $400.00 survey for an amount ($1600.00) more than agreed on originally. There is no written agreement or contract. The original amount of $400.00 was agreed upon verbally over the phone. The billed amount is $1600.00. A summons was issued for an appearnace in a Florida court suing for the $1600.00. A lein for the amount due was attached to the property. The person suing refuses the $400.00 amount originally agreed upon. How can I proceed without appearing in Florida. Can this company leggally colect this $1600.00 without a written contract? Your guidnace would be appreciated. I want to settle this but its not realistic to travel to and from Florida, high an attorney to dispute this case. Does Florida require a written contract between parties in such circumstances. What do you have for suggestions. Thank you for your help.

If you default a judgment will be entered against you. Without proof, it is your word against theirs.
