Legal Question in Credit and Debt Law in Florida

My son is 29 years ago and has moved back home. He has been without a job off and on that has caused his current debts to become unpayable at the current time. I would like to manage his finances while he is with me to get him back on track. Can I somehow legally get this control over him?

He could give you a Durable Power of Attorney . In FLorida when you sign a Power of Attorney it becomes effective then. We have no springing - which would mean at a later time or time designed by the giver.

There are plenty of things that you can do to assist your son. If you choose the forceful route of taking his finances over that's your prerogative. Unfortunately if you take the reigns and don't involve your son in this process he is doomed to repeat the same mistakes.

You should involve your son in formulating a strategy to deal with his debt problems. If you have the financial ability to assist, you could work out settlement plans with his creditors to help regain good credit standing. Or if bankruptcy is necessary step, then you could pay the attorney for preparation and filing of the petition and assist your son with the process.
