Legal Question in Credit and Debt Law in Florida

Out Of State Garnishment Of Wages.

I may in the near future have a private individual file a small claims court case against me in the state of Kansas. If they win I'm sure they will want to garnish my wages as I do not have the amount they are seeking. If they win where do they have to file for the garnishment and what laws apply? the laws of Kansas or the laws of Florida? Any assistance would be greatly appreciated.

Re: Out Of State Garnishment Of Wages.

If you are employed in Fl., then garnishment would be in Fl., under Fl. laws, including Fl. exemptions. The foreign judgment would have to be domesticated in Fl. prior to a garnishment being effective.

I suggest you invest in a consultation with a competent creditors' rights atty.
