Legal Question in Credit and Debt Law in Florida

Stop Payment on check

I purchased a laptop computer on ebay. I sent my check from my home equity account from my bank in Michigan to the seller in Florida. After 10 days I learned from ebay that the seller was no longer a member of ebay. Since, I had heard nothing from him during the 10 days, I stopped payment on my check, the next day.

The check was cashed at the Check Cashing Store in Florida by the seller. Now the Check Cashing Store wants me to pay for it.

I never received the laptop computer. I also file an internet fraud report against the seller.

Do I have to pay?

Re: Stop Payment on check

If the stop payment became effective with your bank, (Bank did not Honor the check b/c of stop payment) I would say let them try, it will not be an easy task. So fight paying it.

If the stop payment had not become effective by your bank, and the check was honored by your bank, you may have a problem.

FYI, the check cashing store has criminal rights against the seller and they can file a police report here in Florida.
