can i sue a collection agency

if a collection agency will not verifie a debt can you sue them in small claims to get them to remove the listing off my credit report and what state can i do this in mine(fl)or theirs (tx)I've already fild a complaint against them in tx with the states attorney general office

Yes. See the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. You are best reatining counsel. Damages include attorney fees.
