Legal Question in Credit and Debt Law in Florida

Summary Judgment of Replevin

Approximately 2 months ago I was served a Writ of Replevin for failure to make payments on my motorcycle. At that time I called the repo company and had them come get the motorcycle. Today I received a Notice of Hearing for the Plaintiff's Motion for Summary Judgment. I assume that H-D will now tell me they sold the bike forhalf it's value and I owe the balance, fines, storage, interest and whatever else they can legally tag me with. I have been unemployed for 6 months now, with no unemployment insurance payments. My question is, what can I expect at this hearing? Or more to the point, can they send me to jail when they find out I cannot repay any or all of it at this time? Do I have any options?

Re: Summary Judgment of Replevin

We do not have a debtor's prision in the US. You will have a judgment entered against you. Make them prove the case and challange the costs etc.

In the near future, I will have helpful articles on these issues on my web site at www.ConsumerLawyerHelp.com.
