Legal Question in Credit and Debt Law in Florida

A summons has been sent to me from Asset Acceptance LLC, po box 318037, Cleveland, Ohio 44131 -- Jeffrey Sobeck via Trumbull County Court of Common Appeals, Warren, Ohio . to my address in Florida via forwarded mail. I have to send a copy of my answer to the court anf Asset Acceptance within 28 days. If I fail to appear and defend judgement by default will be taken per Karen Infante Allen, Clerk of Courts for relief demanded in the complaint. total amount 24541.71 that the plaintiff prays for judgement against the defendent plus 4% per annum interest of 8,653.60

The summons states that a complaint has been filed by Asset Acceptance for payment of an old credit card debts (2 )# 1. date of delinquency 8/12/1996 perchased on 08/21/2000 # 2 date of deliquency 08/05/1996 purchased on 03/10/2000

The statute of limitations has expired on both of the accounts.

I do not live in Ohio and my legal residence is in Florida where the certified letter was forwarded but am expected to appear in court in Ohio??

On all of this is the statemnt that this info is from a debt collector.

I do not have the means to pay this back.

I married in 12/6/ 2005 changing a combined income. MY wife is not responsible for my old bills.

Any advice would be greatly appreciated

Sincerely,

Walter T. Davis

Asset Acceptance could not prove a case if it tried. Moreover, they must sue you in the county in which you live. Get a consumer lawyer to help you. The lawyer will probably get his or her fees from Asset Acceptance. To find a consumer lawyer in your area, go to
