Legal Question in Credit and Debt Law in Florida

Summons Received

My husband and I received a suumons this am regarding an old debt from our small business we closed 2 years ago. The company that is suing us already sued us in small claims court and we have since satisfied the judgment. They took over this other company that we owe and are suing us again. Can they do that? The same company sue twice?

Re: Summons Received

It sounds like the owners of the first company (Company A) bought a second company (Company B). At one point in time, you owed money to Company A and to Company B. Company A sued you, got a judgement, and you satisfied the judgment. Company B is now suing you.

It is immaterial whether the owners of Company A and Company B are the same.

The important distinction is that Company A and Company B are different entities, and that the debt upon which Company B is suing is a different obligation than the obligation upon which Company A sued you.
