Legal Question in Credit and Debt Law in Florida
They are taking me to jail.
i have an outstanding debt from providian bank from when i was 21 and never paid back. they have recently threatened to take me to court, and court has supenaed me to attend hearings and i have completely ignored them because ive been scared, i cant pay them back at all. now the courts have send me a letter stating that they are going to send me to jail for not complying. i currenly dont live in florida anymore but would like to settle this and not have to worry anymore. i am in no position to re-pay my old debt and would consider bankruptcyor any other options rather than paying them back. i am extremely upset as how they have handled my situation. i just dont want to have a criminal record with the law. please advise. what are my rights?

Re: They are taking me to jail.
If they are taking you to jail it is because you have not complied with the court's orders. In Florida, you can not be placed in jail for failing to pay a judgment [unless it is something like child support]. My suggestion is that you contact the attorney, fill out their forms, advise the court of your financial situation and ASK FOR HELP. If you continue to hide and be scared, it will only get worse. From what you have stated, you have not committed a crime. Also consider contacting a Bankruptcy Attorney as that may be a quick and easy solution. YOu can file Bankruptcy in North Carolina or Florida -- remember it is YOUR RIGHT as a Citizen of the United States. It is a law intended to protect YOU. I hope you find courage from this answer and seek immediate help.
