Title Company mistake cost me $260...worth taking to court?
I recently closed on a new home. Our contract gave us cash on closing to remodel some things. The title company cut us our check and we were on our way. Two weeks later we received an additional check in the mail for $260 (the amount of our inspection) from the title company, along with a letter stating that the bill had already been paid. We considered this extra money and spent it. 2 months later, the company that did the inspection sent us a bill for $260, saying it has yet to be paid. When we asked the title company about this they acknowledged they had made a mistake and told me to just go ahead and pay it. I explained that I had already spent that money, thinking that it was extra, and that they should be held responsible. They refused to pay the bill and now I have to come up with an additional $260. I would have never spent this money to begin with if they hadn't made this error, so it's actually costing me $260 extra. I know it's not a lot of money, but it's the principle of the matter. I'm an honest man and I'm not trying to seize an opportunity to get something for nothing. Does this sound like a legitamite complaint? If so, can I file a small claims lawsuit? Thank you in advance!

No, it's not a legitimate complaint. You owed for the inspection, the inspector didn't get paid, now you have to pay for it. You wound up with a bonus $260, and you think you can just keep it? Pay the inspector.
