Legal Question in Credit and Debt Law in Florida

Traffic citation issued 12 years ago.

I received a collection letter from a collection agency on behalf of the Miami Dade Clerk of Court. When I contacted them to inquire about this, I was informed that it was issued 04/09/93/. I told them I would dispute this debt because I have no recollection of this and asked them to provide me with proof of it. The rep called me back and was insisting that I pay it off to prevent further action. What should I do about this?

Traffic Citations are NOT considered Consumer Debts so the Federal Debt Collection Practices Act does NOT apply. The only way you can dispute the debt is by asking a traffic judge for a court hearing. Before you rush to pay it, you might want to talk to a traffic attorney because by paying it they may place points on your license and your insurance may increase. I can not give an opinion on the specifics of your case because it is not my area of practice. Hope that helps.
