Legal Question in Credit and Debt Law in Florida

We turned in a car to the bank that we could not afford. They sold the car at auction and now are trying to collect $12,000, the difference of the loan amount and the car's selling price. We just received a Motion for Summary Judgment in the mail stating that Plaintiff is entitled to Summary Judgment as to Count I of the Complaint for a Mobile Home Deficiency. Should we respond to this Motion? Can they garnish wages and attach assets?

Yes, you should answer the complaint and see if Florida Statute 537.012 Repossession, disposal of pledged property; excess proceeds has been complied with.
