Legal Question in Credit and Debt Law in Florida

unable to pay credit card debt

What are the legal ramifications if I stop paying my $30.000 in credit card debt? I am a 50 yr old single mom of 2 children and am self employed. I have no assets and I rent a home. I don't have any medical insurance because I owe to much each month on credit debt. I take ownership in getting myself into debt but I can't keep living from week to week trying to scrape together the min. payments. The stress is getting to me. Thank you for your answer.

Re: unable to pay credit card debt

First, many of my clients are in the same situation as you are and ask for this type of help. It takes courage to confront your financial problems.

I imagine that you have poor credit. If so, it sounds like you are a strong candidate for a bankruptcy proceeding and you should review your options and file a CHAPTER 7. If a bankruptcy attorney advises that you only qualify for a chapter 13 bankruptcy, then before you file, please contact my office to discuss your situation.

In general, when you stop paying your debts, the credit cards will "charge off" the debt and sell it to debt collection agencies. They will start calling and most likely harassing you. In order to exercise your rights against them, please visit my web page and read the "articles". My page is www.FLORIDACREDITLAWYER.com. I have taken a lot of time to write these articles, which are free of charge, to help consumers who are having financial difficulty. Note, that if the debt collectors violate your rights, you may be able to sue them and receive up to $1,000 even though you owe the debt.

Some of the credit companies and/or debt collectors may try to take you to court. If you get served with a law suit, DO NOT IGNORE IT. Call my office for further assistance.

Finally, please let your friends and family know about our web page, as there are very few consumer attorneys focusing on credit law, and many consumers need to find answers to their credit problems.
