Legal Question in Credit and Debt Law in Florida

Unsecured Debts

I have about $70,000.00 in credit card debts and I cannot pay the monthly payments. We have three kids and my wife and I struggle just to make ends meet. I own my home but its not paid off. Can the creditors take me to court for not paying them and can they come after my home with liens or garnish my wages? Will it be wise to just send them what ever I can afford a month even if they do not agree to it? I looked into bankrupsy but from I have been told according to the new law I would have to file for chapter 13 and pay back everything I owe in 5 years which does not make any sense to me and would be impossible because I can even make the minimun payments now. Could someone please give me some guidence on this, because this is really tearing our family appart.

Thank you,

Garcia
