Legal Question in Credit and Debt Law in Florida

vehicle repossession

I received a letter on Oct 11th from my lender stating in bold capital letters that oct 15th was the last day to pay my past due amount or they could repossess, etc. I was getting paid on the 12th and would be paying the past due amt; however, awoke on the 12th (3 days before my deadline) to find my car had already been repossessed. I called Honda to indicate I could make payment and that they had given me until the 15th, but they still refused to reinstate the car to me.

Re: vehicle repossession

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

If you were delinquent in making your payment, they have the right to repossess the vehicle. You would expect to be able to rely on their letter giving you a deadline, however, I do not believe that the deadline date in the letter would be controlling or limit their ability to take the car sooner. You may wish to try and call the office of the president of the finance company and explain your circumstances and see if there is anything to be done. All major companies have people specially trained to deal with complaints that reach that level and they try to resolve them.
