Voluntary Reposession
I had a voluntary reposession April 1999. I told the car dealership, Ugly Duckling, I was moving to Puerto Rico, and had to return my truck. I asked if there would be any problem and I was told no there wouldn't be the salesman I dealt with assured me that they could sale the truck for more than I owed. Of course, I did not get this in writing. I heard from a collection agency about 6 mths. later, and told them that I was not going to pay the full amount owed because I know they sold it. I never heard anything else regarding this issue. Now, I rec'd a letter in the mail from an atty. wanting to represent me in a case against me. Ugly Duckling has filed a Judgment against 4 1/2 years after the fact. I have not been served. The case was filed on 10/21/03. Is there a statute of limitations regarding reposessions? Please advise me of my options. Thank you.

The Statute of Limitations is 5 years.
