Legal Question in Credit and Debt Law in Florida

Wage Ganishment

AMEX is trying to garnish my wages for a debit. 2 years ago I agreed to pay $175 per month. At that time I had two incomes coming into the house and could afford it. However, shortly after I had made that agreement my boyfirend wiped my checking a savings out, stole my car and left. I am a single mom and don't know what to do. I tried to explain this to the collection lawyer and tried to re-negotiate the monthly payment because I could no longer afford the $175 per month. They wouldn't accept partial payment or anything less than $175. Now they are trying to garnigh my waged. I filled out the Head of Household Exemption form and filed it with the court. Saturday I got more court papers in the mail stating they are denying I am Head of Househould and that they say I waived my rights. If I did I don't remember waiving my rights. I olny said I would pay the $175 per month. I had no control or knowledge that what happend with my boyfriend would happen. I can't aford an attorney and legal aide said I make too much. I am scared. If they garnish my wages I won't be able to live. I do not have any family in Florida and those out of state don't have any money...Please help. I feel like a sitting duck...

Re: Wage Ganishment

You should first consider filing bankruptcy.

Second. You should consider fighting the garnishment. I am not sure you can even waive head of household. Go to www.helpwithlaw.com for more information and help.
