Legal Question in Credit and Debt Law in Florida
Wage Garnishment for Head of Household
I am head of household. I will most likely be threatened with wage garnishment in the near future by numerous credit card companies. The law that was passed in Florida in 1993 allows wage garnishment for head of household beyond $500 after taxes if the person has authorized this in writing. I do not recall signing a waiver specifically for wage garnishment for the creditors. How can I find out if I have signed such an authorization?
Also, my husband's sole income is Social Security. Is that considered a pension and exempt from the non-head of household garnishment for joint debt?

There is no easy way to check if you signed a waiver. I would take the position that you are head of household and signed no waiver...ever..so you can't be garnished.

Chances are you never signed such a waiver. The social security income is exempt.
