wage garnishment

I was told that if I was head of house hold I could not have my wages garnished. I owe a student loan I paid off and on, My ex went to jail a few times and could not afford to pay it when he was in. So they garnished my wages. Instead of 70 dollars a month. Tey take out 133 every two weeks. It is killing me. I'm a single mom and have 2 minor children 7and 10. My ex hasn't paid child support in 7 or 8 months. Is there anything I can do????

Yes,. You must apply to the Court for an order quashing the garnishment based upon the fact that your wages are, by statute,exempt from garnishment. You may also reuest that the garnishee be required to disgorge all funds improperly taken. If can find an atty to help you that would be of major value to you.
