Legal Question in Credit and Debt Law in Florida
my wife is 63 years old and on social security,barely living on her 700.00 a month check. a credit card company sued her around six or seven years ago and she agreed to a payment plan,well her health got so bad that she had to quit working. she called the company after making about 2years of payments and told them she had to quit working and could not keep making payments.she would have had to officially be out of work dissabled for 12 straight months to receive dissability social security. we both needed incomes to pay our mortgage and so she just decided to collect social security which we could continue to pay our living expenses, the company told her that they would consider her payments that were already paid to be enough.of course we never got anything in writing. however this has been at least 3 years ago since they have contacted her until now.they have again started demanding payment.my question is,can they sue her and make her pay on her only income being social security? thank you very much for helping.

Yes they can sue her. Sounds like she does not have anything to give them though, so it is likely that they will not prusue this.
